Privacy Policy
Draft, pending legal review. This document has not been finalized or legally approved and may change before Blake launches.
Last updated [DATE]
This Privacy Policy explains how Amanda Howard HQ, Inc., doing business as Blake ("Blake," "we," "us"), collects, uses, shares, and protects personal information when you use Blake's websites (including blakewith.com and blakewith.me), apps, and services (the "Services"). It replaces the waitlist privacy notice dated October 27, 2026.
Early Access: what is active today
Blake is in Early Access (see the Early Access Addendum). Everything this policy describes is active during Early Access except real payments:
- no payment details are collected from customers;
- no payouts or Cash Out happen;
- no affiliate commissions are collected or paid.
This means the sections on free downloads, opt-in forms, marketing email (including email engagement tracking), Blakely and Blake Studio (including photo uploads), and creators' customer and subscriber information apply now. If Blake runs payment tests, they use test transactions that collect no real card details. We will update this section when real payments begin. [Before publishing: confirm in production that Blakely, Blake Studio and Studio photo uploads are actually on. Remove any that aren't from this section.]
1. Who this policy covers, and Blake's role
- Creators and their team members who have a Blake account. For their account information, Blake decides how it is used (Blake is the "controller").
- Affiliates who promote creators' products through Blake. Blake is the controller of their account and commission information.
- Customers and subscribers of creators, meaning people who buy from, claim a free download from, book with, or subscribe to the emails of a creator's store. For this information, the creator is in charge of why and how it is used, and Blake processes it on the creator's behalf to provide the Services (Blake is the creator's "processor" or "service provider"). See Section 9. If you are a customer or subscriber, contact the creator about their use of your information; we will help them respond.
- Visitors to Blake's websites and creators' storefronts, and people on Blake's waitlist.
2. Information we collect
Information you give us
- Account information: name, email address, password (stored only in hashed form), and two-factor authentication settings.
- Store information: store name and address, branding, products, files, courses, storefront and email content, business profile, and similar content you create.
- Plan billing: Stripe processes your payment details for Blake subscriptions; we receive limited details such as the card brand, last four digits, expiry, and billing country, not the full card number.
- Payment account information: to sell or receive commissions, you complete Stripe's onboarding. Stripe collects your identity, business, tax, and bank information. Blake receives status information from Stripe (for example, whether payments and payouts are enabled, your account's country, verification requirements, balance, and payout status), not your full bank account number or identity documents.
- Communications with us, including support requests and conversations escalated from Blakely.
- Blakely and Blake Studio prompts, conversations, and outputs, and the photos and brand assets you upload for Blake Studio.
- Storage: uploads are stored privately for your store only and served through short-lived links.
- Deletion: you can delete them, and they are deleted when your account closes. The Section 7 rules for account information apply.
- Waitlist sign-ups: email, first name, and your email-consent choice.
Information we collect for creators (about their customers and subscribers)
- Customer and order information: name, email address, products purchased, amounts, order status, refunds, and access to purchased products.
- Subscriber information: email address, name if provided, the consent you gave (the wording shown, the page, and the time), your subscription status, and email delivery events (such as delivered, bounced, or complained).
- Coaching bookings: the session time, time zone, and any note you add.
- Notes and tags a creator adds about their customers.
Information collected automatically
- Sign-in session. Cookies needed to keep you signed in.
- Affiliate referral cookies. When you follow an affiliate's link, we set a cookie (and add a signed code to the page address) that records which affiliate link you followed for that product, so the affiliate who referred your purchase can be credited. These cookies last up to 90 days and contain no personal information about you beyond a link and click identifier.
- Click records. When an affiliate link is followed, we record the click with a keyed one-way hash of your IP address (not the address itself) to avoid counting duplicate clicks.
- Storefront analytics. When you view a creator's storefront or product page, we record the page viewed, the referring website's domain, and campaign (UTM) tags. This analytics is cookieless and does not store your IP address or a session identifier. If your browser sends a Global Privacy Control or Do Not Track signal, we do not record these views.
- Security and abuse prevention. We use Cloudflare Turnstile on some forms to tell people from bots, and keep short-lived, hashed records of IP addresses and emails to enforce rate limits (deleted after about a day).
- Device and log information our hosting providers record to run and secure the Services, such as IP address, browser type, and request logs.
- Push notifications. If you allow notifications in a Blake app, we store your device's push token. Notifications never include a customer's name.
- Email engagement (marketing emails sent through Blake). Marketing emails that creators send through Blake (broadcasts and sequence emails) contain a tiny invisible image (a tracking pixel) and links that pass through Blake. The footer of each one says so and links to a page where you can turn this off.
- What is recorded:
- the first time an email was opened, and how many times;
- which links were clicked, and when;
- whether you bought from that creator within 5 days of clicking one of their emails. This is matched by your email address within that store; no cookie or link code is used.
- What is not recorded: your IP address, device, mail app or location. No cookies are set.
- Transactional emails are never tracked. These include receipts, access emails, sign-in links and payout emails.
- Unsubscribe and preference links are never used for tracking.
- Retention: engagement records are deleted with the email, the contact or the store, and are otherwise kept for [retention period].
- Who sees it: only the sending store's owners and admins.
- Turning it off:
- a creator can turn tracking off for their whole store;
- you can choose "Don't count my opens and clicks" for a store without unsubscribing;
- blocking images in your email app also stops open tracking. Some mail apps load images automatically, which can count as an open.
- What is recorded:
We do not use advertising cookies, third-party analytics cookies, or tracking pixels on websites. Email tracking is limited to the marketing-email engagement described above.
3. How we use information
- To provide the Services: run your account and store, process sales and refunds through Stripe, deliver purchased products, send transactional emails (receipts, sign-in links, booking confirmations, payout updates), send creators' marketing emails on their instruction and measure their engagement (opens, clicks, and resulting purchases), track, collect and transfer creators' affiliate commissions through Stripe, pay Blake Referral Program commissions, enable Cash Out, and provide analytics.
- To provide Blakely and Blake Studio (Section 6).
- To bill for Blake plans and manage reservations and referrals.
- To keep the Services secure: verify identity, prevent fraud and abuse, enforce our Terms and policies, and protect users, customers, and Blake.
- To provide support and communicate with you about the Services, including service announcements and changes to our terms.
- To send you Blake marketing (for example, launch news) if you agreed or where the law allows; you can unsubscribe at any time.
- To improve the Services, using aggregated or de-identified information.
- To comply with law and respond to lawful requests.
Where the law requires a legal basis (for example, in the UK or EU), we rely on performing our contract with you, our legitimate interests in running and securing the Services, your consent (for example, for marketing email), and compliance with legal obligations.
4. How we share information
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
- With the creator whose store you use. Customers' and subscribers' information is available to that store's owner and authorized team members according to their role (for example, only owners and admins can see and export subscriber lists and financial balances). Creators never see other stores' customers or data.
- With affiliates, in limited form. Affiliates see their own links, clicks, and commissions. They do not see customers' names or email addresses.
- With service providers who process information for us under contracts requiring them to protect it:
- Stripe: payments, payment accounts, plan billing, identity verification, and payouts.
- Supabase: database, authentication, and file storage.
- Vercel: hosting, scheduled jobs, and custom domain setup.
- Resend: sending email.
- Anthropic: the AI model behind Blakely and Blake Studio.
- Cloudflare: Turnstile bot protection.
- Expo: delivering push notifications to the Blake apps.
- Microsoft: our business email.
- Embedded content. Courses may embed videos from YouTube (privacy-enhanced mode), Vimeo (do-not-track mode), or Loom, chosen by the creator. When you play them, those providers receive information under their own privacy policies.
- For legal reasons, safety, and business transfers. We may disclose information to comply with law or legal process, to protect rights, safety, and the Services, or as part of a merger, acquisition, or sale of assets, subject to this policy.
5. Payments and Stripe
When you buy from a creator, your payment is processed by Stripe on the creator's Stripe account. Stripe receives your card and billing details directly, under Stripe's Privacy Policy; Blake does not receive your full card number. If a creator offers one-click add-on offers after checkout, your card is kept by Stripe on the creator's account, and you are told before paying; you are never charged without clicking.
6. Blakely and Blake Studio
- When a creator uses Blakely or Blake Studio, their prompts (including photos they choose to give Blake Studio), and the information needed to answer (which may include their store's information and any customer information they type or that a read-only lookup returns), are sent to our AI provider, Anthropic, to generate a response.
- We do not use this information to train AI models, and our AI provider does not use it to train its models under our agreement with it. [Legal to confirm.]
- Conversations are private to the creator who had them (not visible to their team), can be deleted by them, and are kept for [12 months] unless deleted sooner or required longer by law. Lookups Blakely makes are logged for security. If a creator asks to talk to a person, the conversation and its lookups are shared with Blake support.
7. How long we keep information
- Account and store information: while your account is open, and for a reasonable period afterward to handle Cash Out, disputes, and legal obligations.
- Order, payment, and commission records: for as long as needed for accounting, tax, and dispute purposes, generally [7 years].
- Subscribers: until the creator deletes them or closes their store. Addresses that unsubscribed, bounced, or complained are kept on a suppression list so they are never emailed by mistake.
- Blakely conversations: [12 months] (Section 6).
- Rate-limit records: about one day. Waitlist entries: until launch communications end or you ask us to delete them.
- Backups: deleted information may remain in backups for a limited period.
8. Your choices and rights
- Access, correction, deletion, and export. You can view and update much of your information in your account. To request a copy of your information or a correction, email [privacy@blakewith.com]. To delete your account, use Delete account in the Blake app, Request account deletion in your account settings on the web, or email [privacy@blakewith.com] (see blakewith.me/legal/delete-account). We will confirm your identity using your account email. Customers and subscribers of a creator should contact the creator first; we will help the creator respond.
- Email tracking. Use the "Turn this off" link in any marketing email's footer to stop a store counting your opens and clicks; you stay subscribed. Blocking images also stops open tracking.
- Email. Every marketing email includes an unsubscribe link. Unsubscribing from a creator's emails stops that creator's marketing; you can also choose to stop marketing email from all stores on Blake. We will still send transactional messages, such as receipts.
- Cookies. You can block or delete cookies in your browser; blocking sign-in cookies prevents signing in, and blocking referral cookies may prevent an affiliate from being credited.
- Global Privacy Control. We honor GPC signals as described in Section 2.
- California residents. You have the right to know, access, correct, and delete personal information, and not to be discriminated against for exercising these rights. We do not sell or share personal information as defined by the CCPA. You may use an authorized agent.
- UK, EU, and other residents. You may also have rights to restrict or object to processing, to data portability, to withdraw consent, and to complain to your local data protection authority.
- We will respond to requests within the time the law requires.
9. Data processing for creators
When Blake processes customers' and subscribers' personal information on a creator's behalf, Blake: processes it only to provide the Services and on the creator's instructions; keeps it confidential and secure; uses the service providers listed in Section 4 as sub-processors and requires them to protect it; helps the creator respond to individuals' requests; notifies the creator without undue delay of a personal data breach affecting it; and deletes or returns it when the creator's account ends, subject to legal retention. [A full Data Processing Addendum is to be provided by legal.] Creators are responsible for having a lawful basis and giving any notices required for their own use of that information.
10. Security
We protect information with measures including encryption in transit, access controls that keep each store's data separate, role-based permissions, two-factor authentication for Blake staff with every staff action logged, and private storage with short-lived download links for product files. No system is perfectly secure; please use a strong password and two-factor authentication.
11. Children
The Services are not directed to children under 13, and Blake accounts are for people 18 or older. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.
12. International transfers
Blake is based in the United States, and information is processed in the United States. Where the law requires, we use appropriate safeguards (such as standard contractual clauses) for transfers.
13. Changes
We will post changes to this policy here and update the date above. If a change is material, we will notify you by email or in the product before it takes effect.
