Affiliate Terms

Draft, pending legal review. This document has not been finalized or legally approved and may change before Blake launches.

Last updated [DATE]

These terms apply to two groups:

  • Affiliates: you, when you join a creator's affiliate program on Blake to earn commissions by referring sales of that creator's products.
  • Creators: creators who run affiliate programs.

These terms are part of the Blake Terms of Service. They do not cover the Blake Referral Program, which pays for referring new Blake customers (see the Referral Program Terms).

1. Joining a program

  • Any Blake account holder may apply to a Creator's program, on any plan. Buyers may also receive a personal invitation to promote a product they bought. Creators may approve applications automatically or review them, and may decline any applicant.
  • To be paid, you connect a payout account through Blake: a Stripe account in a supported country, set up for manual payouts (Section 4).
    • You can join programs and be credited for sales before you connect one.
    • A commission is only collected for you if your payout account is ready when the referred checkout starts (Section 4).
  • Your relationship is with each Creator whose program you join. You are an independent contractor, not an employee, agent, or partner of the Creator or of Blake.
  • Your link: for each product you promote, you receive a permanent link at blakewith.me/affiliates/[code].
  • Recording a click: when a buyer follows your link, a cookie (and a signed code in the page address) records it for that product for up to 90 days.
  • The buyer's newest valid choice wins. You are credited if both of these are true:
    • the buyer buys that product within the Creator's attribution window (1 to 90 days, default 30);
    • your link is the newest valid link they followed for that product.
  • Other products: a link for a different product never removes your credit for this one.
  • Invalid links: if the newest link is not valid (for example, the affiliate was removed), earlier valid links are checked, newest first.
  • Attribution is decided by Blake's records at the time checkout starts. Blake's determination is final, absent manifest error.
  • No commission is earned on:
    • your own purchases, or those of the Creator or their team (self-referrals);
    • purchases made without following your link;
    • order bump add-ons, one-click upsells or downsells, or recurring membership or payment-plan charges [at launch; legal to align with DECISIONS-NEEDED #9 if this changes];
    • sales the Creator refunds or loses in a dispute (Section 5).

3. Commission amounts

  • The Creator sets the commission rate for each product (0% to 90% of the price paid, after discounts and excluding taxes).
  • The rate shown when the referred purchase is made applies to that purchase. A Creator may change rates for future sales at any time.
  • Blake takes no part of your commission and charges no fee on it.
  • Stripe's processing fees on the sale are the Creator's.

4. How commissions are collected and paid

  • Collected from the sale. When a referred buyer pays, Stripe charges the sale on the Creator's own Stripe account. Your commission is taken from that sale at the same time, as a Stripe application fee.
    • Blake receives it only to pass it on to you, in full.
    • The Creator never pays you by hand.
  • Sent to you automatically. Blake transfers your commission to your payout account as soon as Stripe makes the funds available. Blake adds no holding period.
    • While Stripe is settling the sale, your commission shows as pending.
    • Once it is transferred, it is in your Stripe balance.
  • Not collected. If you have no payout-ready account when the referred checkout starts, or if commission payouts are not yet switched on, the commission is recorded as "not collected" and shown to you and the Creator.
    • Blake did not receive it, so Blake cannot pay it.
    • The Creator keeps that amount.
  • Manual Cash Out. Your payout account is set so Stripe does not pay out automatically. You send your available balance to your bank with Cash Out in Blake.
    • Blake may pause Cash Out while it confirms your payout settings with Stripe.
    • While a dispute is open on a sale whose commission was already sent to you, the disputed amount is held back from Cash Out until the dispute ends. Nothing else is held.
  • Blake's role. Blake runs the tracking, calculation and automatic transfer through Stripe. Blake does not pay commissions from its own funds, and it does not guarantee a commission that was never collected.
  • Taxes. You are responsible for taxes on your commissions. Blake or Stripe may ask for tax information and issue tax forms where the law requires.

5. Refunds, chargebacks, and recovery

These rules follow Blake's approved recovery policy (2026-10-27):

  • Before your commission is sent. If a referred sale is refunded (in full or in part) or disputed, the commission is reduced or reversed in proportion, or held until the dispute ends. The collected amount goes back to the Creator.
  • After your commission is sent. If a sale is refunded or charged back:
    • Blake reverses the related transfer from your Stripe balance (in proportion for partial refunds) and returns it to the Creator.
    • If your balance can't cover the reversal (for example, because you already cashed out), the amount becomes something you owe back to that Creator.
  • Offset. Any amount you owe back to a Creator is applied against 100% of your later commissions from that same Creator until it is cleared.
    • While anything is owed back, your affiliate account is restricted with that Creator only, and you can see the balance.
    • You may also settle it directly with the Creator.
  • Dispute outcomes.
    • If the Creator wins the dispute, a held commission is released to you, once.
    • If the Creator loses, the Creator keeps the reversal or offset.
    • A refund is treated like a lost dispute for the refunded share.
  • Nothing is forgiven automatically. Amounts owed back stay visible until cleared; there is no automatic write-off.
  • Other Creators are never affected. Commissions from other Creators are never used to offset what you owe one Creator.
  • Dispute fees are not passed on to you.

6. Rules you must follow

  • Disclose clearly, wherever you promote a link, that you may earn a commission (FTC and similar laws).
  • Do not make false or misleading claims about a product, its results, or its price. Follow the Acceptable Use and Content Policy, including its rules on earnings claims.
  • Do not:
    • refer yourself;
    • create fake clicks or purchases, stuff cookies, or use misleading redirects;
    • bid on a Creator's brand name in paid search without the Creator's permission;
    • spam people with your links.
  • Do not present yourself as the Creator or as Blake.

7. Removal and ending the relationship

  • A Creator may remove you from their program at any time. From that moment, your links for that Creator stop earning on new purchases. Commissions already earned on purchases made before removal remain subject to these terms.
  • You may leave a program at any time.
  • Blake or a Creator may withhold or reverse commissions earned through a violation of these terms.

8. Creator obligations

Creators who run programs agree to the following:

  • Collecting commissions: commissions are collected from their referred sales as described in Section 4. This is part of Stripe's processing of the sale on their account.
  • Recovery: the recovery rules in Section 5 apply to refunded or disputed sales.
  • No side arrangements: they will not make side arrangements that conflict with these terms.

9. Liability

The Blake Terms of Service apply to these terms, including the disclaimers, limitation of liability, and dispute resolution sections.
