Copyright and DMCA Policy

Draft, pending legal review. This document has not been finalized or legally approved and may change before Blake launches.

Last updated [DATE]

Blake respects intellectual property rights and expects users to do the same. This policy is part of the Blake Terms of Service.

1. Reporting infringement

If you believe content on Blake infringes your copyright, send a notice to our designated agent with:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim is infringed.
  3. Identification of the material you claim is infringing and its location on Blake (for example, the store and product address).
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Designated agent: Copyright Agent, Amanda Howard HQ, Inc. (dba Blake), [ADDRESS]. Email: [copyright@blakewith.com].

2. What we do

We will remove or disable access to the material identified, notify the creator, and provide them a copy of the notice. Sales of a removed product stop; customers who already bought it may keep access unless the law or the claim requires otherwise. [Legal to confirm.]

3. Counter-notices

If you believe material was removed by mistake or misidentification, you may send a counter-notice to the designated agent with your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification, and your name, address, telephone number, consent to the jurisdiction of the federal district court for your address (or, outside the U.S., any judicial district where Blake may be found), and agreement to accept service from the person who sent the original notice. We may restore the material after 10 to 14 business days unless the original complainant tells us they have filed a court action.

4. Repeat infringers

We will terminate the accounts of users who are repeat infringers in appropriate circumstances.

5. Misrepresentations

Anyone who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f).
