Acceptable Use and Content Policy

Draft, pending legal review. This document has not been finalized or legally approved and may change before Blake launches.

Last updated [DATE]

This policy is part of the Blake Terms of Service. It applies to everyone who uses Blake, and to everything sold, published, or sent through it. Stripe's own Restricted Businesses list also applies to anything sold through Stripe on Blake; if Stripe prohibits it, Blake does too.

1. Prohibited products and content

You may not sell, offer, publish, or send through Blake anything that is, or that promotes:

  1. Illegal goods, services, or activities, or instructions for committing crimes.
  2. Sexually explicit content, pornography, or adult services, or any sexual content involving minors (which we report to the authorities).
  3. Content that harasses, threatens, bullies, or doxxes anyone, or promotes violence, terrorism, or hatred against people based on protected characteristics.
  4. Content that infringes intellectual property, privacy, or publicity rights, including reselling others' courses, templates, or files without permission (see the Copyright and DMCA Policy).
  5. Weapons, explosives, drugs, drug paraphernalia, or regulated substances; gambling, lotteries, or games of chance; and other businesses Stripe restricts.
  6. Get-rich-quick schemes, pyramid or multi-level marketing schemes, and unsubstantiated earnings claims (Section 3).
  7. Financial, investment, credit repair, debt relief, or trading signal services that require licenses you do not hold, or that promise returns.
  8. Medical, health, or wellness products or claims that are false, unsubstantiated, or offered as a substitute for professional care, including claims to diagnose, treat, or cure disease.
  9. Deceptive products: products that do not exist or are not delivered as described, fake reviews or testimonials, and impersonation of any person, brand, or Blake.
  10. Malware, phishing, or content designed to collect credentials or payment details deceptively.
  11. Content created with AI that misrepresents a real person, or that you could not lawfully publish if you had written it yourself.

2. Prohibited conduct

You may not:

  1. Access, or attempt to access, other users' accounts or data, or Blake's systems, without authorization, including by probing, scanning, or testing vulnerabilities (report security issues to [security@blakewith.com] instead).
  2. Interfere with or disrupt the Services, including by excessive automated requests, or circumvent rate limits, usage limits, plan restrictions, or AI spending limits.
  3. Scrape the Services or copy, sell, or resell them, except as the Terms allow.
  4. Manipulate affiliate attribution: self-referrals, fake clicks or purchases, cookie stuffing, forcing clicks, or misleading people about what a link is (see the Affiliate Terms).
  5. Abuse the Blake Referral Program, including impersonating Blake, bidding on Blake's brand terms, or referring yourself (see the Referral Program Terms).
  6. Use Blake to process payments for another business, or to accept payments for products you do not sell (factoring).
  7. Create accounts to evade a suspension or termination.
  8. Use Blakely or Blake Studio to generate content that violates this policy, to attempt to extract other users' information, or to circumvent safety measures.

3. Earnings and income claims

Blake is software, not an income opportunity, and creators who sell business, marketing, or "make money" products must be careful about what they promise.

  • Do not promise or imply that customers will earn a specific amount, or any amount, unless the claim is truthful, typical for your customers, and you have evidence to support it.
  • If you show results, clearly describe what typical customers achieve, and do not present exceptional results as typical.
  • Do not use Blake's name, a Blake milestone award, or a Blake plaque to suggest that Blake guarantees earnings or endorses your product.
  • Follow the U.S. Federal Trade Commission's rules on endorsements, testimonials, and earnings claims, and similar laws where your customers live.

4. Email marketing rules

In addition to Section 11 of the Terms:

  1. Send marketing email only to people who opted in to hear from you. Do not buy, rent, scrape, or share email lists.
  2. Keep your sender name, subject lines, and content honest and not misleading.
  3. Do not hide or remove the unsubscribe link or your postal address, and honor unsubscribes immediately (Blake does this automatically).
  4. Keep complaint and bounce rates low. Blake may pause a store's sending for review if complaints exceed [0.1%] of messages sent, or if we receive reports of unwanted email.

5. Affiliate disclosures

Affiliates and creators who feature other creators' products must clearly disclose affiliate relationships where they promote them, as required by the FTC and similar laws. Blake shows a disclosure on storefronts that feature affiliate products; affiliates must make their own disclosures elsewhere (for example, in social media posts).

6. Enforcement

We may review content and accounts, and may remove content, pause features (including selling, Cash Out, email sending, AI, or affiliate payouts), suspend, or terminate accounts that violate this policy or create risk, as described in the Terms. We are not obligated to monitor content but may act on reports. To report a violation, email [trust@blakewith.com].
